Can I get divorced in Canada if I was married in another country?

Yes. To file for a divorce in Canada under the Divorce Act, it does not matter where you were married.


The only requirement to initiate divorce proceedings relates to residency in a province in Canada. For example, if you wish to initiate divorce proceedings in British Columbia or Ontario, you or your spouse must have been habitually resident in either of these provinces for at least one year. This means that if you have been living in British Columbia or Ontario for more than a year, you can initiate divorce proceedings against your spouse, even if they are living in another country.
